Some of the time we get called in for trees that aren’t our client’s property. Most of the time its just for a raising above or clearing of a structure. Common sense usually dictates the laws on this. If the tree is doing actual damage to your structure you have the right fix the problem. If the tree is posing a real threat to your property you also have the right to fix the problem. A real threat defined by damaged, broken, dead limbs hanging over ones property. Getting approval from the tree owner/neighbor is the first thing to do. In some cases we run into a Hatfield/McCoy relationship between client and neighbor, and in these cases a third party often helps in expressing concerns. If there still is a problem a city forester can be called in to inspect and possibly condemn a tree.
